ROSEWOOD-CEDARWOOD UPDATE: Tenant Union Lawsuit Reaches Court
A year since the announcement of the Rosewood-Cedarwood Tenant Union’s lawsuit against their new property owners for violating the Low-Income Housing Tax Credit program and threatening to convert their homes into luxury senior housing, court hearings are underway.
With over 50 STUN members present, the judge heard arguments from tenants about how forced relocation would do irreparable damage to RWCW’s communities. Comparatively, arguments from Mitchell and Amanda Jenkins’ attorneys centered on that the Jenkins shouldn’t be held liable for a program rule they had no knowledge about.
We believe the facts will prevail: Mitchell and Amanda did not do their due diligence in researching their investment and the tenants have no fault. There is no case like this in Missouri history. It holds potential to become a powerful precedent for community-centered housing in Springfield and across the state. We hope to hear in the next few weeks whether a preliminary injunction will be granted.
